Mr. Yassin represents clients in complex business and real estate acquisition transactions to complex litigation matters involving breach of contract, professional fiduciary duty breaches, shareholder derivative actions, unlawful and unfair competition, trade secret defense, product and premises liability, commission disputes, and catastrophic injury claims throughout California.
Mr. Yassin has successfully mediated and resolved hundreds of complex litigation matters. In those cases for which informal settlement is not possible, Mr. Yassin has managed and undertaken numerous lengthy binding arbitrations and civil jury trials obtaining numerous favorable arbitration awards and jury verdicts involving commercial breach of contract and fiduciary duty claims, unfair business competition claims, brokerage commission awards and personal injury matters.
REAL ESTATE AND COMMERCIAL BROKERAGE REPRESENTATION
Mr. Yassin has focused his practice to the representation of commercial property owners and commercial brokerage litigation throughout California. Mr. Yassin represents individual and limited liability entities in the acquisition, leasing, management and reselling of commercial and industrial properties. Mr. Yassin represents numerous commercial brokers and brokerage service companies, handling a variety of professional liability/fiduciary duty claims, prosecution of commission payment claims, and participating in trade arbitration disputes regarding conflicting commission claims on transactions. Mr. Yassin’s real estate experience extends to real property damage claims arising from lateral support and subsidence events, boundary line disputes, easement and right of access litigation claims, title and lien enforcement claims, and disclosure actions in the acquisition of residential and commercial properties.
Mr. Yassin has over 17 years of business litigation experience throughout California. Mr. Yassin actively manages numerous litigation matters on behalf of individual and institutional clients from the early filing stages, through discovery, mediation and eventual trial or arbitration as necessary. Mr. Yassin prosecutes and defends cases and easily moves between vigorous advocacy on both sides of the Bar. Mr. Yassin represents clients in business/contract litigation, breach of fiduciary duty and disclosure cases as well complex personal injury, construction defect and employment litigation matters.
EXPERIENCE – REPRESENTATIVE MATTERS INCLUDE:
Successfully obtained arbitration award in excess of $500,000 on disputed brokerage commissions for industrial property located in Ontario, California.
Successfully obtained defense jury verdict on Conversion and breach of contract lawsuit against national REIT client.
Successfully obtained arbitration defense award on behalf of California retail business arising from alleged breached of credit card servicing agreements saving the client several hundred thousand dollars in improperly charged service fees.
Dramatically reduced potential exposure to clients in multi-million shareholder derivative action through elimination of majority of claims through arbitration and then further reduction of final award through post-arbitration litigation and settlement negotiations.
Successfully obtained directed verdict defense judgment on behalf of commercial brokerage arising from claimed breaches of fiduciary duties and fraud claims brought by disgruntled tenant.
Successful defense of numerous property owners arising from allegations of unfair business practices, unlawful housing discrimination and rent control violations.
